MARCH 20, 2007 MINUTES

President Click called the monthly County Council meeting to order. All recited the pledge to the flag.

It is noted that Councilman Kendall is absent.

TAX LETTER
Council President Click explained the letter being sent to the taxpayers concerning a late collection date.

DOG TAX
Councilman Click said he would like to appoint a committee to review the Dog Tax Ordinance and come up with a recommendation to the Council. Councilman Duckwall will head the committee and Councilman McCauliffe volunteered to be on the committee. The County Attorney will be involved to assist them in their research of the issue.

EAGLES POINTE
The Council discussed the settlement with the Estates at Eagles Point. Councilman Click told the new members of the Council that last year the Council agreed to use either the Riverboat Fund or the Rainy Day fund. When time comes to pay the amount the Council will have to decide which Fund or what portion out of each they wish to use.

ADDITIONAL APPROPRIATIONS
Prosecutor Eric Huneryeager asked the Council to appropriate $22,496 for him to hire a person to handle the Deferral funds. Mr. Huneryeager explained that he is moving the Deferral all in house for better accountability since he is responsible for it. There is new software that he has to use for the State and he cannot accurately keep track of it when most of it is at this time going through the City Deferral program. He explained that these funds are from tickets issued for speeding. If you get a deferral and do not commit another infraction within 6 months no points are added to your driving record. These funds are for public service equipment. He has bought cars for the Sheriff as well as other equipment such as radios. He has also bought items for all other law enforcement agencies in the County. After some discussion with some of the new Council members, a motion was made by Councilperson Mull to allow the $22,496 to be used by the Prosecutor at his discretion. Councilman McCauliffe 2nd the motion. Councilman McCauliffe asked if FICA etc could be taken from this amount if the Prosecutor started someone on a part time basis. The Prosecutor said it could and that is more than likely what he will do at this time. The Council will review this position during budget hearings. Councilman Click said he would like the amount cut in half and used as part time. Councilperson Mull said she feels confident the Prosecutor will use it part time and wisely. A vote of 5-1 was cast. Councilman Wiles voted against. Motion passed.

Councilman Click asked if anyone in the audience had any questions or discussions. Those in attendance did not.
Councilperson Mull said she has had some phone calls about the cleaning of the sides of the road with a Bush Hog. She said it looks awful because of the chewing of the brush. Councilman Click said Cass County uses this method and it does look bad for a few weeks, but when the leaves come on you can’t tell how it was cut.

A motion to adjourn was made by Councilperson Mull. The motion was 2nd by Councilman Wiles. The motion passed 7-0.
