MIAMI COUNTY COUNCIL
2008 BUDGET HEARINGS
DAY 2
SEPTEMBER 5, 2007

President Click opened the 2nd day of budget hearings. The Pledge to the flag was recited and Councilman Duckwall led us in prayer.

The Council discussed cuts that they had made on the previous day. The Council also discussed the cutting of the Cumulative Court House rate. It would bring in around $116,000 to County General if they adjust the rates.

Councilman Click said he felt they are going to have to freeze hiring and salaries at the 2007 level unless they find more to cut. He also told the Council of the Department of Local Government Finance warning concerning our spending more than we are taking in. The consensus of the Council was taken. Councilman Hunt feels they may not have any alternative, Councilman Kendall asked if they were going to have to take away the Matrix that was given to the Road Deputies last year, Councilman Wiles said he does not like the employees taking a hit with no raise. Councilman McAuliffe said he is for giving the employees a raise, Councilman Duckwall said based on the information available, there is not enough money to meet expenses much less give raises. Councilperson Mull said she feels the State sets on our levy and gives us very few alternatives. Councilman Click thanked the members for their input.

The Treasurer told the Council that Fulton County adopted their budgets with a raise contingent on approval of the budgets by the DLGF. The Council liked the sound of that and think they may be able to give a 3% salary raise if they can find some things to cut today.
A motion was made by Councilman Kendall to give the employees a 3% raise contingent on the approval of the 2008 budgets by the DLGF. The motion was 2nd by Councilman Wiles and passed 5-2. Councilperson Mull and Councilman Duckwall voted against. Councilperson Mull feels it is giving the employees a false sense of hope. Councilman Duckwall said he prefers to know where we stand financially before we give the raise.

All of the budgets were read on the 2nd day of hearings.

Health #1
Councilperson Mull moved to increase the Health Officer’s salary request. The motion died for lack of a 2nd. Councilman Kendall moves to give the 3% increase along with the other Health Department employees. The motion is 2nd by Councilman Duckwall. The motion passed 4-3 (Hunt, Click and Mull voted against).

A motion was made by Councilman Duckwall to adopt the Health budget with the amendments. The motion was 2nd by Councilman Wiles and passed 7-0.

Health Environmental #2
A motion to adopt this budget as amended was made by Councilman Kendall. The motion was 2nd by Councilperson Mull and passed 7-0.

Health Coordinator #3
Councilman McAuliffe made a motion to leave the salary at the level requested. The motion was amended by Councilman Duckwall with the addition of accepting the entire budget as submitted. The amended motion was 2nd by Councilman McAuliffe and passed 7-0.

Health Registrar #4
A motion to approve the budget as amended was made by Councilman Duckwall. The motion was 2nd by Councilman Hunt and passed 7-0.

Treasurer #48
A motion to approve the budget as amended was made by Councilman Hunt. The motion was 2nd by Councilman Wiles and passed 7-0.

Weights & Measures #17
A motion to approve the budget as amended on the 2nd reading was made by Councilman Wiles. The motion was 2nd by Councilperson Mull and passed 7-0.

Coroner #18
A motion to approve the budget as amended was made by Councilman Hunt and 2nd by Councilman Kendall. The motion passed 7-0

Museum #19
Councilperson Mull moved to approve the budget as amended. The motion was 2nd by Councilman McAuliffe and passed 7-0.

9-1-1 #25
A motion was made by Councilperson Mull to adopt as amended on the 2nd reading. The motion was 2nd by Councilman Duckwall and passed 7-0.

Highway Phase 1 #5
A motion was made by Councilman Duckwall to approve as amended. The motion was 2nd by Councilperson Mull. Commissioner Hawley asked the Council to consider the pay request in this budget. Sam Waltz said he would like at some time to ask the Council to consider a merit system for the highway department. No action taken on these requests and the original motion passed 7-0.

Highway Phase 2 #6
Councilman Wiles moved to approve as amended. The motion was 2nd by Councilman Kendall and passed 7-0.

Highway Phase 3 #7
A motion was made by Councilman Kendall to approve this budget as amended. The motion was 2nd by Councilperson Mull and passed 7-0.

Highway Phase 4 Major Moves #8
A motion was made by Councilman Duckwall to approve this budget as submitted. The motion was 2nd by Councilman McAuliffe and passed 7-0.

Highway LRS #9
A motion was made by Councilman Duckwall to approve the budget with amendments. The motion was 2nd by Councilman Kendall and passed 7-0.

Cumulative Bridge #10
A motion was made by Councilman Wiles to approve the budget as amended. The motion was 2nd by Councilman Kendall and passed 7-0.

EMA #11
Councilperson Mull made a motion to approve this budget as amended for the 2nd reading. The motion was 2nd by Councilman Hunt and passed 7-0.

LEPC #16
Councilman Wiles made a motion to approve this budget with amendments. The motion was 2nd by Councilman Duckwall and passed 7-0.

Sheriff #21
A motion to approve this budget as amended was made by Councilperson Mull. The motion was 2nd by Councilman Duckwall and passed 7-0.

Jail #22
A motion was made by Councilperson Mull to approve this budget as amended. The motion was 2nd by Councilman McAuliffe and passed 7-0.

Transport Officer #23
A motion was made by Councilman Duckwall to approve this budget as amended for the 2nd reading. The motion was 2nd by Councilman McAuliffe and passed 7-0.

User Fee Continuing Education #24
A motion was made by Councilman Duckwall to approve this budget for the 2nd reading as submitted. The motion was 2nd by Councilman Kendall and passed 7-0.

Community Corrections budgets #43
This budget was approved with no formal action taken since the judge said the Council has no say over it.

Superior Court #27
A motion was made by Councilman Wiles to approve this budget as amended for the 2nd reading. The motion was 2nd by Councilman Hunt and passed 7-0.

Clerk of the Court #28
A motion was made by Councilman Hunt to approve this budget as amended. The motion was 2nd by Councilperson Mull and passed 7-0.

Superior Court Clerk #29
Councilperson Mull made a motion to approve this budget as amended. The motion was 2nd by Councilman Hunt and passed 7-0.

Clerk Elections #30
A motion was made by Councilman Duckwall to approve this budget as submitted. The motion was 2nd by Councilman Hunt and passed 7-0.

Clerk Registration #31
A motion to approve this budget as amended was made by Councilman McAuliffe and 2nd by Councilperson Mull. The motion passed 7-0.

Public Defender #32
Councilperson Mull made a motion to approve this budget as amended. The motion was 2nd by Councilman Wiles and passed 7-0.

Public Defender Supplemental Fund #33
A motion was made by Councilman Kendall to approve this budget on 2nd reading as submitted. The motion was 2nd by Councilman Hunt. The motion passed 6-0. Councilman Duckwall was out of the room for this vote.

VSO #35
Councilman McAuliffe made a motion to approve this budget as amended. The motion was 2nd by Councilperson Mull and passed 6-0. Councilman Duckwall was still absent.

Extension Office #12
Councilman Hunt made a motion to approve this budget as amended for the 2nd reading. The motion was 2nd by Councilman Kendall and passed 7-0.

Plan Commission #34
Councilman Wiles made a motion to approve this budget as amended for the 2nd reading. The motion was 2nd by Councilman Kendall and passed 7-0.

The next order of business is to adopt a part time/hourly rate. A motion to keep the part time rate at $10 per hour was made by Councilman Hunt. The motion was 2nd by Councilman Duckwall. The motion passed 6-1. Councilman McAuliffe opposed.
A motion was made by Councilman Duckwall to keep the 9-1-1 part time rate at $12.50 per hour. The motion was 2nd by Councilperson Mull and passed 7-0.

The following per diem for various Boards were acted upon:

Merit $37
Health $50
Zoning $30
Public Defender $25
LEPC $20
Drainage $50

The miscellaneous Boards rates are as follows:
Sheriff extra Jail Deputy $80 per day
Sheriff Extra Road Deputy $80 per day
Jail Part-time cook $80 per day
Jail Part-time communicator $80 per day
PTBOA Board $60 per day

A motion to accept these rates for the Boards was made by Councilman Kendall. The motion was 2nd by Councilman Hunt. This motion passed 7-0.

A motion to establish a mileage rate of 40 cents per mile was made by Councilman Hunt. The motion was 2nd by Councilperson Mull and passed 7-0.

After some discussion with the County Commissioners a motion was made by Council Duckwall to leave all established tax rates at the current level. The motion was 2nd by Councilperson Mull. The motion passed 7-0.

Prosecutor #36
A motion was made by Councilman Duckwall to approve this budget as amended on the 2nd reading. The motion was 2nd by Councilman Hunt and passed 7-0.

IV-D #37
The Prosecutor requested one of the deputy positions be a 1st deputy rate. After reviewing the budget a motion was made by Councilman Wiles to approve this budget as amended with the current positions (no 1st deputy). The motion was 2nd by Councilman Kendall and passed 7-0.

User Fee Deferral #38
A motion was made by Councilman Kendall to approve this budget as amended in the 2nd reading. The motion was 2nd by Councilman Hunt and passed 7-0.

VOCA #39
A motion was made by Councilman Duckwall to approve the VOCA grant budget as amended contingent upon grant approval for the Grant period of July 1, 2008 through June 30, 2009. The motion was 2nd by Councilman Wiles and passed 7-0.

Probation #40
The Council discussed the request for an additional probation officer. Councilman Click feels they should defer this until the new jail is finished. He doesn’t feel the funds are available this year to approve an additional position. Councilman Kendall feels the County needs the position. Councilman Kendal made a motion to approve this position on contingency of the DLGF approving budgets. The motion was 2nd by Councilperson Mull. The motion failed 1-6. Councilman Kendall was the only yeah vote.

A motion to approve this budget as amended (no new Probation Officer) was made by Councilman Duckwall. The motion was 2nd by Councilperson Mull and passed 7-0.

Probation User Fee #41
Councilperson Mull moved to approve as amended on the 2nd reading. The motion was 2nd by Councilman Hunt and passed 7-0.

Drug and Alcohol Program #42
Councilperson Mull made a motion to approve this budget as amended. The motion was 2nd by Councilman Wiles and passed 7-0. Councilman Duckwall amends the motion to reflect $24,278 for Probation Officer Assistant. The motion was 2nd by Councilman McAuliffe. The motion passed 4-3 (Councilpersons Click, Mull and Wiles voted against.)

Sheriff #21
Councilman Duckwall made a motion to approve the adjusted and amended budget. The motion was 2nd by Councilman Hunt and passed 7-0.

Jail #22
Councilman Hunt made a motion to adjust and approve the amended budget. The motion was 2nd by Councilman Kendall and passed 7-0.

Transport Officer #23
Councilperson Mull moved to approve the adjusted and amended budget. The motion was 2nd by Councilman Hunt and passed 7-0.

CASA #46
Councilperson Mull moved to approve the amended budget for the 2nd reading. The motion was 2nd by Councilman Hunt and passed 7-0.

Recorder #49
A motion was made by Councilman Wiles to approve the amended budget on the 2nd reading. The motion was 2nd by Councilman McAuliffe and passed 7-0.

Assessor #51
A motion was made by Councilman Hunt to approve the amended budget for the 2nd reading. The motion was 2nd by Councilperson Mull and passed 7-0.

Reassessment #52
A motion was made by Councilman Wiles to approve the amended and adjusted budget on the 2nd reading. The motion was 2nd by Councilman Duckwall and passed 7-0.

Peru Township Assessor #53
Councilman Wiles moved to fill the position requested. Councilman Kendall 2nd the motion. The motion failed 3-4. Click, Mull, Duckwall and Hunt voted against. Councilman Duckwall said this is not personal but he feels the County has to hold the line on spending this year.
Councilperson Mull made a motion to approve the amended budget (no additional deputy). The motion was 2nd by Councilman Hunt and passed 7-0.

Surveyor #50
Councilperson Mull moved to approve the amended budget. The motion was 2nd by Councilman Wiles and passed 6-0-1 (abstain), Councilman McAuliffe abstained from this vote.

Soil & Water Conservation District #13
Councilman McAuliffe moved to approve the amended budget on the 2nd reading. The motion was 2nd by Councilman Hunt and passed 7-0.

Soil and Water Grant #14
Councilman Duckwall moved to approve this budget as submitted. The motion was 2nd by Councilman Hunt and passed 7-0.

LCC #15
Councilperson Mull moved to approve this budget as submitted. The motion was 2nd by Councilman Duckwall and passed 7-0.

Circuit Court #26
Councilperson Mull moved to approve the amended budget for the 2nd reading. The motion was 2nd by Councilman Hunt and passed 7-0.

Auditor #47
A motion was made by Councilman Wiles to approve the amended budget on the 2nd reading. The motion was 2nd by Councilman McAuliffe and passed 7-0.

Pipe Creek Assessor #54
Councilman Hunt moved to approve the amended budget for the 2nd reading. The motion was 2nd by Councilperson Mull and passed 7-0.

Township Assessors #55
Councilman Hunt moved to approve the amended budget for the 2nd reading. The motion was 2nd by Councilman Wiles and passed 7-0.

Council #56
A motion was made by Councilman Hunt to approve this budget as amended. The motion was 2nd by Councilman McAuliffe and passed 7-0.

Welfare #20
A motion to approve the Welfare budgets as presented was made by Councilperson Mull. The motion was 2nd by Councilman Duckwall and passed 7-0.

Commissioners #57
A motion was made by Councilman Hunt to approve the budget as amended. The motion was 2nd by Councilman Duckwall and passed 7-0.

Court House #58
Councilperson Mull moved to approve the amended budget. The motion was 2nd by Councilman Wiles and passed 7-0.

Cumulative Court House #59
Councilman Hunt made a motion to approve the amended budget. The motion was 2nd by Councilman McAuliffe and passed 7-0.

CEDIT #60
A motion to approve the budget on the 2nd reading was made by Councilperson Mull. The motion was 2nd by Councilman Duckwall and passed 7-0.

Drainage #61
Councilman Wiles made a motion to approve the amended budget for the 2nd reading. The motion was 2nd by Councilman Hunt and passed 7-0.

A motion to adjourn the 2nd day of budget hearings was made by Councilperson Mull and 2nd by Councilman Wiles.

Motion passed 7-0.
