MIAMI COUNTY COUNCIL
25 NORTH BROADWAY
PERU, INDIANA
NOVEMBER 21, 2006

Councilman Stephenson called the monthly meeting of the County Council to order. All recited the pledge to our flag.

MINUTES
A motion was made by Councilman Click to approve the minutes from September 5 and 6, 2006. The motion was 2nd by Councilperson Mull and passed 7-0.

A motion was made by Councilman Click to approve the minutes from the October 17, 2006 meeting. The motion was 2nd by Councilman Robertson and passed 7-0.

ADDITIONAL APPROPRIATIONS
Sheriff Roland requested a reduction from the 08 Sheriff budget to the 09 Jail budget. The motion was made by Councilman Click to approve the transfer and 2nd by Councilman York. The motion passed 6-0-1 with Councilman Robertson abstaining.

Sheriff Roland asked about an Ordinance to raise the fees for accident reports. County Attorney David Grund will give the Ordinance to the Auditor’s Office to advertise and it will be acted upon in December.

PROBATION DEPARTMENT REQUEST FOR AUDIENCE
Susan Rice explained to the Council that the Probation Department and the Judges have discussed the current process in recovering fees charged by the Courts to probationers. At this time a Probation Officer has to keep track of the fees collected and keep track of any that have not been paid. If they had an additional clerical position this would allow the Officers to do their job and the collection of fees would be handled separately. Councilman York feels this would be a much better process. Ms. Rice said the position would be fully funded out of the juvenile user fee fund and community correction project income. At this time Ms. Rice estimates they are $50,000 short in collections for this year.

Councilman York asked about the position. Ms. Rice said it would be a first deputy position. The Council agreed that she should come back in January for the additional appropriation.

MCEDA/Jim Tidd
Mr. Tidd brought an amended inter-local agreement before the Council for consideration. MCEDA wants to offer an incentive to GAB Ventures by subsidizing the clients rent on the spec building by 30 cents a square foot every year for 5 years. This would amount to about $153,000. They currently still have $188,000 from the current agreement available. Mr. Tidd also said the 3% interest will continue to escrow until the loan is paid off but it would extend the time out 5 years on the loan. A motion to approve the amended inter-local agreement was made by Councilman York. The motion was 2nd by Councilman Robertson and passed 6-1. Councilman Click voted against.

MATRIX INFORMATION
Councilman Click told the Council that he came across some information while working on the job study that the Jail Matron does not have to be paid at the same level as a road deputy. Councilman Click said that the Sheriff told the Council during Budget hearings that the Matron is to be paid the same as a Road Deputy and that is not true. It is Councilman Click’s understanding that the County can set the salary. Councilman Click recommends that David Grund review this. Councilman Stephenson said the new Council will have to deal with this issue.

WAGE STUDY
Councilman Click said he will get a meeting with the incoming Council and others to go over the wage study when it is complete.

PROSECUTOR/ LAW ENFORCEMENT FUND ORDINANCE
David Grund introduced an Ordinance to the Council to establish a fund to be used for confiscated funds from drug busts. He explained that currently there is a fund used by the City and all proceeds go to the Peru Police Department. The Prosecutor has funds in limbo because there is no fund to place them into. He also explained that if cars, boats, houses or anything else of value is ceased; they can be sold and those funds would be placed into this fund. If the Sheriff Department would need a new car this fund could be used for the purchase. Councilman Kendall moves to adopt Ordinance 11-20-06 to establish the fund. The motion was 2nd by Councilman York and passed 7-0.

DISCUSSION/DOG TAX ORDINANCE
Commissioner Hawley told the Council that he would like action taken on this ordinance in December so it could go into effect January 1, 2007. He explained it is necessary because animal kills would come out of the general fund.

DISCUSSION
Councilman Cook told the Council this would be his last meeting because he is heading south for the winter. He stated he had enjoyed working with them. Mr. Cook said it has been quite a ride!

IVY TECH
Mr. Stephenson reminded the Council members that they are invited to an open house at Ivy Tech on December 5, 2006 from 4-7pm.

HVAC SYSTEM LAST PAYMENT
Councilperson Mull wanted to bring to the attention of all that the Auditor had paid the last payment for the Court House heating and cooling system.
