MIAMI COUNTY COMMISONERS
25 NORTH BROADWAY

NOVEMBER 13, 2007

Commissioner Hawley called the weekly meeting of the Board to order.

REPLACEMENT OF SMOKING POTS
Commissioner Hawley discussed the replacement of the damaged smoking pots outside. Barkos Outdoor Equipment has the same style for $80+ shipping. It was decided to ask Stan Helton if he knows of a better offer before ordering. Commissioner Boyer moves to replace the smoking pots. The motion was 2nd by Commissioner Deeds and passed 3-0.

SMOKING CESSATION
Mike Wilson asked the Board if they were any closer to holding open public meetings for a Smoking Ordinance for Miami County by years end.

PAYROLL
Commissioner Deeds moves to approve payroll. The motion was 2nd by Commissioner Boyer and passed 3-0.

COUNTY ATTORNEY/DAVID GRUND
The Commissioners asked David Grund if he had received any documents from ICE Miller on forming a holding corporation for the building of the new jail. Attorney Grund said that he hadn’t received any at that time but would follow up with ICE Miller.

COUNTY DOG CATCHER
Tony & Jody Bartel talked to the Commissioners about their pit bull dogs being taken by the Dog Catcher and then being put to sleep. Jerry Tigler, Animal Control Officer, reported later that he received a call from Indian Camp Grounds about barking dogs. He had to tranquilize the dogs for removal because they were aggressive. He then later talked with the owners about picking the animals up. They did not show. Jerry then reported that he could not give them proper care without danger to himself and others. The dogs were euthanized.

2010 CENSUS
John Powell, Darrell Wooten and Jim Comerford were inquiring if the information for the 2010 Census has been approved and returned. All paperwork needs to be returned by November 22nd and the County has 120 days to review all Census data for errors. Jim Comerford presented the form to be signed for the Census. Commissioner Deeds made a motion for Commissioner Hawley to sign the forms. Commissioner Hawley 2nd and passed 2-0.

IT/SYSTEM BACK-UP
John Powell informed the Commissioners that the County needs a better computer back-up system. The current data back-up system is not providing reliable information. It is possible to save the County money by building the system in-house for $7,000. Commissioner Deeds motions to approve the money. Commissioner Boyer 2nd the motions and is approved 3-0.

IVY TECH NOTICE
Commissioner Deeds received a notice from Ivy Tech that they have received their money from the County.

GIE INSURANCE
Commissioner Hawley received notice from GIE Liability Insurance that a Tort Claim filed on the County was denied by Christopher Garrison. Another claim filed was denied by Jon Hensley.
GIE Insurance also sent a notice that a claim for a ’99 F 550 Ford truck has been paid to the Highway Department for $2,148.95.

ANNEX AWNING
Wabash Valley Restoration is painting the awning on the Annex Building. Commissioner Boyer motions to process they check but, hold them until the job is completed. Commissioner Deeds 2nd and the motion passed 3-0.

COURT STREET CLOSURE
Commissioner Hawley received a request from the Chamber of Commerce to close Court Street on November 14 from 6:30 p.m. - 8:30 p.m. for Christmas Open House. Also, they requested a police escort for the beginning of the parade but were notified that the city was providing this service.

BUNKER HILL FERTILIZER
The Commissioners received a Tax Deed notice for Bunker Hill Fertilizer parcel 52-11-32-200-004.000-018 to Miles & Peggy Straley. The notice was forwarded to the Commissioners because it was the most current address in the taxing system. The information was forwarded on to County Attorney Grund.

CLOSURES FOR JAIL DOORS
A bill from Pauly Jail Building for door closures for $698.97. Commissioner Deeds motions for it to be paid from Cumulative Court House. Commissioner Boyer 2nd and motion is passed 3-0.

HIGHWAY
Sam Waltz requested that bids for fuel be taken starting 12-03-07 and closed 12-10-07 at 11:30 a.m. They will be awarded that same day. Commissioner Deeds motions and Commissioner Boyer 2nds and it passed 3-0.
Sam also discussed trading in the Highlift truck for a different model.
Maconaquah Park would like a culver replaced.

SHERIFF GENERATOR
Dave Vitek reported the new generators should be online this coming Friday. He also inquired who should be in charge of putting fuel into them the first time. Commissioner Hawley said that he believed that fuel would be supplied upon installation.

COUNTY ELEVATORS
Commissioner Hawley received a proposal for Metro Elevator Service to maintain all 4 county elevators. The County currently has a contract with AMCO. Metro is requesting a 3 year contract. AMCO is requested to submit a new bid.

HEALTH BOARD
Commissioner Hawley has been approached by the Health Board about replacing Dr. Farag on the Health Board. The Commissioners are requesting the Health Board provide them with a list of candidates.

HIGHWAY ENGINEER
Ken Einslen brought a letter from the state concerning a Field Check that is taking place 12/04/07 starting at 10:00 a.m. for Business 31. They will be checking road constructional resurfacing. They will be meeting in the parking lot of the Best Western at Business 31 and 31.

RECESS
Commissioner Deeds motions to recess until 1:30 and Commissioner Hawley 2nd. The motion passes 2-0.

Commissioner Hawley reconvenes the meeting at 1:30

NEW JAIL PRESENTATION
RQAW said that the square footage has been changed to 57,204 square feet.
Drain relief for the 4-H Fairgrounds was incorporated into the drainage for the Jail grounds.
Heating options was discussed. Geo thermal was not considered a viable option as that it would take over 150 wells to control the climate in the jail. Currently using Heat Exchanger’s appears to be the most economic with a pay back within a year or two.

Vacuum sanitary system was discussed as an option to the standard sanitary system. The vacuum system saves 15-20% on water usage.
Bid dates were set tentative as being taken on 1/17/08 and being given 2/14/08.
It was stated that the design development estimate is $14,071,299 coming in $750,000 under the Schematic design.
Commissioner Deeds motioned RQAW, Umbaugh and Associates and CCI to proceed with the project. Commissioner Boyer 2nd and motion passes 3-0.

JAIL HOLDING CORPORATION
The nominations for the Jail Holding Corporation Board of Directors are Jeffrey M Hagan from Commissioner Deeds, Roger Vincent from Commissioner Boyer and Jeff Butts from Commissioner Hawley. Commissioner Deeds motions that the nominations are closed. Commissioner Boyer 2nd and motions passes 3-0. Commissioner Hawley asks for a vote and passes 3-0.

ADJOURN
Commissioner Deeds makes a motion to adjourn Commissioner Boyer 2nd and passes 3-0.
