MIAMI COUNTY BOARD OF COMMISSIONERS
25 NORTH BROADWAY
PERU, INDIANA 46970
OCTOBER 2, 2006

Commissioner Hawley called the weekly meeting of the Miami County Board of Commissioners to order.
Commissioner Boyer is absent.

TORT CLAIM
The Board received a tort claim from Jalissa Smith regarding an accident on State Highway 124. Commissioner Deeds made a motion to forward to the County Attorney. Commissioner Hawley 2nd the motion and it passed 2-0.

GIE CLAIM
The Board received a claim from GIE. They are going to have the County Attorney look at and advise.

EMA/MIKE PECONGA
Mike Peconga reminded the Board about the District 3 exercise on October 19TH.

Mr. Peconga also advised the Board that 5 people have lost their ID cards (one of them was a key card). This brings up two issues:
1. Where do we get the money to pay for the replacement cards?
2. John Powell, IT Director, needs to know immediately when a card has been lost so he can deactivate it.
After some discussion the Commissioners decided that the first lost ID card would be replaced but if the person loses it, the person would be charged a fee (amount to be determined next week).
Commissioner Deeds made a motion to have John Powell type a memo to all staff informing them that he has to be notified immediately when one is lost and that each employee will be allowed one loss after that they will pay a fee. Commissioner Hawley 2nd the motion and it passed 2-0.

Mr. Peconga also told the Commissioners that Holly Mallow asked to have ID key cards for CASA volunteers. The Commissioners discussed and do not have a problem with ID cards to verify volunteer status but not to allow key cards.

FOOD SPECIALIST
Carol Biddle informed the Commissioners that she is not one of the options listed on the phone tree and feels she needs to be so people can call her directly instead of having to go through someone else. The Board will talk with John Powell to get that done.

RADEL ROAD
Ralph Clymer told the Commissioners that in his opinion Radel Road (150E) is dangerous. The Board will speak with the Highway Engineer.

IVY TECH
The Board received a letter from the Ivy Tech Foundation regarding Tax deduction for contributions. It was determined that doesn’t apply to the County.

NIPSCO REQUEST
The Board received a request from NIPSCO to allow them to install a gas line at 200 w between 600 and 650 s. Commissioner Deeds made a motion to allow. The motion was 2nd by Commissioner Hawley and passed 2-0.

MINUTES
Commissioner Deeds made a motion to approve the minutes as presented. Commissioner Hawley 2nd the motion and it passed 2-0.

ANIMAL CONTROL VACCINES
Commissioner Hawley ordered the vaccines for the Animal Control Officer. The Board had approved for the last Officer to get the shots and he wasn’t able to. The County will pay for them.

HIGHWAY
Sam Waltz received bids for a new mechanic truck. Mr. Waltz’s recommendation was to get the cab and chassie from Grahm Ford for $26,564.88 and the body from Delphi Body for $7,476.00. Commissioner Deeds made a motion to allow and Commissioner Hawley 2nd the motion. Motion passed 2-0.

The new phone system for the Highway should be up and running by Wednesday of next week.

The Board discussed Radel Road with Mr. Waltz and he will take a look at it and speak with Mr. Clymer.

Mr. Waltz informed the Board that there was some vandalism and theft of signs this weekend.

WHITE PINE LAND COMPANY
Gene Clodfelter from White Pine Land Company spoke to the Commissioners about 3 acres of land the County owns by the new bridge on Paw Paw Pike (sec 16, twp 28N, range 5E). White Pine is leasing land in that area for the drilling of oil. Commissioner Deeds made a motion to have David Grund review the paperwork and make a recommendation. Commissioner Hawley 2nd the motion and it passed 2-0.

JAIL REPAIRS
Sheriff Ken Roland and Rick Ploss brought estimates for repairs of the doors at the jail. The estimates were from:
1. Crowder Detention
2. Real Time Detention
3. Pauly Jail Building Company
After some discussion on whether to do all of the repairs or go with the most critical it was decided that a new jail was at ;east 3-4 years out and we need to maintain this facility. Officer Ploss recommended Pauly Jail because they are the only one to come to the jail and see what the needs are. Commissioner Deeds made a motion to proceed with Pauly Jail and Commissioner Hawley 2nd the motion (to be paid out of Cum Courthouse). The motion passed 2-0.

Sheriff Roland also informed the Board that there was an update to the law regarding the charge for accident reports. The update states that the Sheriff is now allowed to charge $5 per accident report. Commissioner Deeds made a motion to have Mr. Grund look at and amend the current ordinance or do a new one (which ever is appropriate). Commissioner Hawley 2nd the motion and it passed 2-0.

ROAD COMPLAINTS
Cedric Prather came before the board to speak to them regarding how ruff the intersection of 250 W and Logansport Road is and would like to know if it could be looked at and fixed.

Mr. Prather also spoke to the Commissioners regarding the intersection of 50 W and the Denver/Mexico Road. This intersection is currently a 3-way stop. He feels the people should not have to stop at the top of the hill (especially in bad weather).

PERU TOWNSHIP ASSESSOR
Mike Chittum came before the Board regarding pay for his part time person. He said when they did the assessment after the tornado her pay should have come out of reassessment. Jane Lilley, Deputy Auditor asked him what fund numbers he put on her time sheet but he didn’t know. Payroll cannot take money out of a fund without proper paperwork. Mrs. Lilley advised him to get with the County Assessor and the payroll Deputy

EXTENTION OFFICE REQUEST
Gary Horner from the extension office brought the lease for his computer equipment before the Board. The 3 year lease is up and he would like to renew it. The Board will check with John Powell. Mr. Horner also asked that they consider raising the amount of the agreement with the Fair Board by $250.00 a quarter. The agreement is to help with utilities for the building and with the prices going up that would help. He realizes that it after budget time but would appreciate anything they could do.

OCTOBER DOMESTIC VIOLENCE AWARENESS MONTH
Jeff Price came before the board to request using either the rotunda or the steps for the Domestic Violence Vigil. He also requested to be able to put crosses on the front lawn in remembrance of those who have died from domestic violence. Commissioner Deeds made a motion to allow both request. Commissioner Hawley 2nd the motion and it passed 2-0.

HIGHWAY ENGINEER
Ken Einselen brought a memorandum for the Pedestrian Crossing signs on the Nickel Plate Trail that was agreed on in the June 19th BOC meeting for the Board to sign. Commissioner Deeds made a motion to sign the memorandum and Commissioner Hawley 2nd the motion. The motion passed 2-0.

COUNTY ATTORNEY
The Board gave Mr. Grund the following items to review:
1. Bill from GIE
2. Tort Claim
3. Addendum for cost of accident reports
4. Land lease agreement

Mr. Grund brought in the modified highway easement. Commissioner Deeds made a motion to move forward and Commissioner Hawley 2nd the motion. Motion passed 2-0.

COIT DOG ORDINANCE
The Board reviewed the COIT Dog Ordinance with Mr. Grund. Mr. Grund will revise and contact the Auditor for her to review.

PROSECUTOR CONFERENCE
Mr. Grund asked the Board about the Prosecutor’s conference out of state. Commissioner Deeds made a motion to allow and Commissioner Hawley 2nd the motion. Motion passed 2-0.

IDEM NOTICE
The Board received a notice from IDEM on Kyle Mussleman.

Commissioner Deeds moved to adjourn. The motion was 2nd by Commissioner Hawley and passed 2-0.
