Chairman Hawley called the weekly meeting of the Board of Commissioners to order.

CHILI COOK OFF
Tammy Baines of the Apostolic Church asked permission to use the Courthouse Lawn for a Chili Cook off on October 14th from 11:30 to 2:30. They would like to get the Community involved. They have asked the Mayor to be a judge for the cook off. Commissioner Deeds made a motion to allow and it was 2nd by Commissioner Boyer. The motion passed 3-0.

Ms. Baines asked about electricity and the Board told her she would have to speak to Peru Utilities.

A T & T MAINTENANCE AGREEMENT
A T & T sent 2 maintenance agreements for the Board to review. The 1st agreement (essential) is $7,809.84 and the 2nd agreement (complete) is $8,827.08. Commissioner Deeds made a motion to refer to John Powell to review and make a recommendation. Commissioner Boyer 2nd the motion and it passed 3-0.

IDEM NOTICES
The Board received the following confined hog feeding operations:
1) Harvey & Shirley Miller
2) Troy Schuler
3) Stan Hodson
4) B & B Pork, Inc.

UPDATE FURNITURE – CIRCUIT COURT
The Commissioners asked Janet Gonsalves, Circuit Court, to come down and explain the quotes for furniture. The biggest difference is Dawalt has the furniture in stock and Smith would have to order it. Commissioner Deeds made a motion to allow $2,519.00 out of Cum Courthouse. Commissioner Boyer 2nd the motion and it passed 3-0. The Commissioners asked Janet to check and see if we could get any trade in or at least have the old hauled away.

DONNA SHEPPARD
Donna Sheppard came before the Board with a problem she is having with the Treasurer. She owns a property that the tax bill was sent to someone else and by the time she received the bill, the taxes were late. The Treasurer waived the penalties. Mrs. Sheppard wrote a check for the taxes which was returned for insufficient funds. When she came up to make good on the check the Treasurer had not only re-applied the penalties but added an $85.00 tax sale fee (because the property was up for tax sale and the County had been charged by the firm hired to do the tax sale) and she wanted the penalties and the tax sale fee removed. She couldn’t understand if the Treasurer had removed them once, why couldn’t she remove them again. Commissioner Deeds said he didn’t believe the Board had any authority over other elected officials. She told the Commissioners that she thought they ran the Courthouse. She said she believes that she gets the “Courthouse Shuffle” when she comes in. She also did not understand why the Auditor’s office did not update their records as soon as deeds were recorded. Jane Lilley, Deputy Auditor, tried to explain the different tax years and the roll over process for taxes. She also asked Mrs. Sheppard as owner of the property, did she inquire to why she didn’t get a tax bill. Mrs. Sheppard replied that she owned a lot of property in Miami County.

A T & T PHONE SYSTEM
John Powell reviewed the phone system maintenance quotes and he said he would not recommend either one.

MIKE PECONGA/EMA
Mr. Peconga informed the Board that the State has a grant for computers (laptops) in the amount of $10,000.00. However the viewer needed to use the laptop for what it is intended to be used for is not ready and they are not to be used for anything else. The County is responsible for the computers but they are to be distributed to other units (fire stations). The County would have to purchase them and then be reimbursed. The Commissioners asked Mr. Peconga to see if we could issue them to the units but keep them stored here until the viewers are ready. Commissioner Boyer made a motion to allow to purchase the computers. Commissioner Deeds 2nd the motion and it passed 3-0.

HIGHWAY ENGINEER
Ken Einselen, Highway Engineer, spoke to the Board regarding the South entrance and the ADA accessibility. Signs to mark the route will be needed as well.

HIGHWAY/SAM WALTZ
Sam Waltz brought a Utility request from Embark for 1000 feet of cable at 1100N. Commissioner Deeds moved to allow. Commissioner Boyer 2nd the motion and it passed 3-0.

The fence at the Highway Dept is done. Commissioner Deeds made a motion to pay the claim out of Cum Court House. The motion was 2nd by Commissioner Boyer. Motion passed 3-0.

MINUTES
Commissioner Deeds made a motion to approve the minutes and it was 2nd by Commissioner Boyer. Motion passed 3-0.

JAIL
Beth Pond, Rick Ploss, and Sheriff Roland came before the Board to talk about problems they have with the control panels at the Jail. They had a list of problems and the Commissioners would like for them to get estimates.

PAYROLL
Commissioner Deeds made a motion to approve payroll. The motion was 2nd by Commissioner Boyer and passed 3-0.

CLAIMS
Commissioner Deeds made a motion to approve the claims. The motion was 2nd by Commissioner Boyer and passed 3-0.

ADVANCE WARNING SIGNS – TRESSELS
Commissioner Deeds made a motion to approve the placing of advance warning signs on the trestles. Commissioner Boyer 2nd the motion and it passed 3-0.

2ND FLOOR COURTHOUSE DOOR LOCKS
Commissioner Hawley had Peru Glass and Screen do estimate on changing the locks on the offices on the 2nd floor. Some keys open other doors. He would like to have a solution for that and a master key made for the custodial people.

PLAN COMMISSION
Darrel Wooten brought an ordinance for rezoning 5 acres at Denver and 19 to residential. Mr. Wooten recommends it be approved. Commissioner Deeds removed himself. Commissioner Boyer made a motion to approve and Commissioner Hawley 2nd the motion and it passed 2-1 (abstain).

Mr. Wooten also brought an ordinance to vacate an alley in North Grove. Commissioner Deeds made a motion to allow. Commissioner Boyer 2nd the motion and it passed 3-0.

The Commissioners took a break to look at the South side entrance.

TREASURER
The Treasurer came before the Commissioner to tell them she would be meeting with Solid Waste in the morning and would like to have a Commissioner attend. Commissioner Hawley will be attending.

Commissioner Deeds made a motion to adjourn. The motion was 2nd by Commissioner Boyer and passed 3-0.
